In one of several organized-crime indictments, Alphonse Persico, who is
described by federal authorities as the acting boss of the Colombo
family, was charged yesterday in the murder of a Colombo underboss,
William Cutolo. An associate, John Deross, was also charged in the
murder. Both are jailed on unrelated charges, and are awaiting a court
hearing on the murder indictment. The authorities said Mr. Cutolo
disappeared on May 26, 1999, which enabled Mr. Deross to become the
Colombo underboss. In addition, Mr. Deross was charged, with Michael
Spataro and Carmine Deross III, both described as Colombo associates,
with conspiring to murder a Colombo soldier, Joseph Campanella. Mr.
Spataro and Mr. Deross III entered not guilty pleas at a hearing
yesterday before Judge Robert M. Levy in Brooklyn. Thomas J. Lueck (NYT)
